What Happened to Our Client?
- Following his birth, Master X's tongue-tie was not identified by medical staff despite the parents’ concern that he was struggling to feed and despite a known family history of tongue-tie.
- Some days after his birth, during a routine home visit, a Health Visitor weighed Master X and discovered he had lost a significant proportion of his birth weight. The Health Visitor identified an anterior tongue-tie.
- The condition, specifically a Class II anterior tongue-tie, was eventually treated privately.
Master X's father acted as a litigant in person and served a Letter of Claim on the hospital trust. The Trust admitted liability and made a settlement offer which was accepted by the litigant in person. The litigant in person instructed MDS to advise and to obtain the Court’s approval of the settlement.

The Outcome of the Case
We instructed an Ear, Nose, and Throat (ENT) consultant to investigate the impact of the negligence. The expert determined that the primary injury was Master X’s inability to breastfeed causing weight loss and distress.
Settlement was approved at a Hearing at which Master X was represented by MDS.
